Since the US Customs Modernization Act, the responsibility and liability to conform to all material Customs Laws and Regulations has fallen squarely on to the Importer of Record.  If your company has any US imports, it is your legal responsibility to “exercise reasonable care”.

As the US seeks funds for the federal treasury, Customs enforcement actions become more aggressive to find material violations and collect substantial penalties. In parallel, more individuals have recently come forward as whistleblowers, both internal and competitors, seeking compensation (moiety) when aware of importer violations.
