Understanding “Compact” For Multistate Practices—The Nuances & Requirements

 

In a world where healthcare facilities are operated by multinational companies across multiple time zones, it seems old fashioned that physicians and licensed professionals have limited capability to conduct a medical practice even in neighboring states. With an increasingly mobile population that is interconnected by social media, it is inevitable that doctors should be able to see patients wherever they work or live. Multistate practice authority is even more critical for those engaged in telemedicine.

Traditionally, each state sets its own licensing and other standards for medical practices within its borders. Being approved in state A though doesn’t necessarily extend to other states, where the approval process must begin again. However, approximately 1/3 of U.S. states in the middle of the country have agreed through a “compact” to provide a coordinated and more streamlined approval process to enable a true multistate practice. Providers need to be aware of the nuances and requirements of the compact. It is also possible to establish a practice in multiple states through a single corporation or limited liability company, but there are regulatory hurdles associated with that option as well.

This session by industry veteran Wayne J. Miller, Esq., will discuss the details regarding the new compact and how it may encourage greater multistate medical practices. The session will also address how PCs and LLCs as well as telemedicine providers cross state lines legally. It will also address some of the unique issues faced by multistate practices, including use of physician extenders, contracting, payor issues, standard of practice requirements and multistate insurance obligations.
