With nearly half of the U.S. states now allowing the recommendation and use of marijuana for medical purposes, providers may be considering whether it is appropriate to assist patients seeking a medical marijuana recommendation. Also, providers may have concerns about the impact of patients who are utilizing medical pot or hail from a recreational marijuana state.
Providers who are interested in adding marijuana recommendations to a practice or clinic need to be aware of both federal and state laws that apply. They also need to be aware of the current standards of care applicable to evaluating patients for this drug, as well as potential regulatory and other risks they face by licensing and enforcement agencies. Fraud and abuse and other laws also may come into play in pursuing transactional arrangements with growers or distributers of medical marijuana.
Physicians and facilities should likewise be cautious in the treatment of patients authorized to use medical marijuana. These patients can be problematic if, for instance, they seek care in states where medical hemp isn’t recognized. Likewise, HIPAA and other considerations come into play if medical marijuana use is reflected in charts that could ultimately be scrutinized by insurers or employers. Lastly, offices and facilities need to evaluate the implications if patients seek to use medical marijuana onsite.
