Last year, CMS finalized several significant changes to the Stark Law. Since these changes have now gone into effect, healthcare organizations must monitor and audit their existing arrangements to ensure that they are in compliance with Stark’s technical requirements and key tenets of defensibility (such as fair market value, commercial reasonableness, as well as not taking into account assigned health service referrals) in case their physician setups are ever challenged.
As healthcare organizations and physicians continue to develop lease arrangements, they need to manage their compliance and enterprise risks by ensuring that their leases continue to stay defensible under the Stark Law. Before moving forward with any further leasing arrangement, the parties must carefully evaluate whether the proposed structure and associated financial terms support compliance with the Stark law’s technical requirements and key tenets of defensibility. This will ensure that they are better prepared to mount some defense in case the lease is ever challenged.
