Lessons Learned From Recent MU Audits

Critical deadlines are here with respect to the financial incentive program offered by Medicare and Medicaid for electronic health record systems (EHR). Providers who have not yet taken advantage of the incentive must start this year or else lose any opportunity to participate. Further, the requirement of showing “meaningful use” (MU) of existing EHR systems takes on new standards, Stage 2 requirements, this year. Providers need to seek exemption from the new requirements or start demonstrating compliance as soon as possible. Failure to meet and to be able to substantiate the standards may result in lost incentive money and, starting next year, even reduced reimbursement.

If providers are not ready to move on to Stage 2, the window for delaying is closing. An exemption from compliance must generally be filed by July. Further, the provider receiving the incentive, such as physicians or hospitals must seek the exemption. If exemption is not sought or is denied, providers need to ensure that their systems have the additional features to meet the more stringent Stage 2 requirements starting this year.

This session by Wayne J. Miller, Esq., will highlight the looming deadlines that impact EHR incentive payments and Medicare reimbursement.

We will also discuss the new Stage 2 standards and how they differ from Stage 1. The exemption process to delay compliance will also be discussed. Also, the presentation will update the meaningful use audit process.
