The Federal Food, Drug & Cosmetic Act, including but not limited to The Food Safety Modernization Act (FSMA) represents the most sweeping change in food law and regulatory landscape in over 70 years. From changes to GRAS and the long awaited definition of ‘gluten free’ to FSMA implementing some rules immediately upon enactment and others being rolled out as proposed rules to be implemented over time in the near future, there is a lot of uncertainty for food companies. But one thing is clear—the need for clarity around what truly is a legal “requirement” versus an “industry standard / best practice”.
