Learn How the Food Industry Is Tackling some of the FD&C Act’s Biggest Changes

The Federal Food, Drug & Cosmetic Act, including but not limited to The Food Safety Modernization Act (FSMA) represents the most sweeping change in food law and regulatory landscape in over 70 years. From changes to GRAS and the long awaited definition of ‘gluten free’ to FSMA implementing some rules immediately upon enactment and others being rolled out as proposed rules to be implemented over time in the near future, there is a lot of uncertainty for food companies.  But one thing is clear—the need for clarity around what truly is a legal “requirement” versus an “industry standard / best practice”.

While addressing the legal requirements of the entire FD&C Act would be too broad to address in this session, expert speaker Melanie Neumann, J.D., M.S. will focus on the legal requirements versus best practices relating to the following topics:

  • FSMA
  • Product Recall (e.g. Reportable Food Registry; FSMA Mandatory Recall)
  • Product Tracking (e.g. Bioterrorism Act; FSMA Traceability of High Risk Foods)

In this program, you’ll learn:

  • What the ‘law’ is under the Bioterrorism Act and FSMA and how the legal requirements of FSMA won’t achieve industry best practices
  • What is legally required and what are the best practices in the world of recalls and traceability requirements, including the Bioterrorism Act requirements
  • How the law and best practices work together to build the best brand protection program

Objective of the session:

  • Gain a deeper understanding of the Food Safety Modernization Act’s requirements in effect now versus pending in proposed form
  • Increase knowledge of how industry is tackling some of the FD&C Act’s biggest changes to the food industry

Who should attend

  • Food law counsel
